Customer agrees to defend, indemnify and hold harmless IntellyHost.com against liabilities arising out of Any injury to person or property caused by any products sold or otherwise distributed in connection with IntellyHost.com's server.
IntellyHost.com reserves the right to intervene with any of the sites hosted on its servers in the interest of its customers. Any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party Copyright infringement any defective products sold to customer from IntellyHost.com's server. IntellyHost.com shall be the sole judge of what violates this Policy.
At this time we bill monthly and annually, depending upon the plan. If you are not satisfied within your first 10 days we would be happy to provide you with a full refund. See our Refund policy.
Clients are encouraged to pay by PayPal as it is the easiest way to handle payment at this time. There are no contract periods but for each successive period, your contract is automatically renewed unless we are notified otherwise. Please note, after we cancel your service you may have to cancel automatic Renewal payment in your PayPal account. If not, the service will be renewed automatically.
All Shared Web Hosting and Reseller Web Hosting packages have a 3-Day Refund period, in which period a full refund is offered if necessary. After that period refunds are evaluated on a case-by-case basis!
IntellyHost.com is not liable for any errors or interruption in service, whether within or outside of IntellyHost.com’s reasonable control. CLIENT understands interruptions may or may not occur and CLIENT will hold IntellyHost.com free and harmless from any damages incurred in any event of any time of loss. Service may be temporarily unavailable for scheduled maintenance, either by IntellyHost.com or by third-party providers, or because of power interruptions or other causes. IntellyHost.com services are not meant for production use and are provided as is without any promise or warranty. In case of any interruptions in the service, CLIENT is responsible for any and all backups relating to his or her website and data stored at IntellyHost.com! IntellyHost.com may or may not provide backups and it is solely at the discretion of IntellyHost.com!
All services provided by IntellyHost.com may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any EU law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless IntellyHost.com and its employees from any claims resulting from the use of the service which damages the subscriber or any other party. Our acceptable use policy is actively and strictly enforced. Offending content or users are suspended from our network, usually as soon as they are discovered, although we will always inform you when and why any action has been taken. Pornography is prohibited on all IntellyHost.com servers. This includes sites that include sexually explicit or hardcore images and/or advertising.
Subscriber acknowledges that the service provided is of such a nature that service can be interrupted for many reasons other than the negligence of the company and that damages resulting from any interruption of service are difficult to ascertain. Therefore, subscriber agrees that the company shall not be liable for any damages arising from such causes beyond the direct and exclusive control of the company.
Subscriber further acknowledges that the company's liability for its own negligence may not in any event exceed an amount equivalent to charges payable by subscriber for services during the period damages occurred. In no event shall the company be liable for any special or consequential damages, loss or injury.
Illegality In any form, including but not limited to the unauthorized distribution or copying of copyrighted software or other data, harassment, fraud, trafficking in obscene material. Undesirable Content Certain types of content are not allowed on our network. We do not host adult content of any description. Content relating to Hacking, Cracking, Warez and IRC is not allowed. Software, audio and video downloads may only be hosted if you are the writer and copyright owner of the resources or you have a right to distribute the materials. Accounts suspended due to content or AUP violation are not refunded under any circumstances.
The following scripts are banned from use on our servers and may not be uploaded or run. Reasons for banning them include adverse effects on server load, invitations to hackers/spammers/criminal activity, etc.
IntellyHost.com offers a free Unlimited DDoS Protection to all Clients. If for any reason your Project attracts daily DDoS attacks, we have the right to disable your account and to ask you for a report that what you are hosting that you attract the large number of the attacks. We will enable again your account if you provide us with informations regarding the attacks. If you ignore our mails/tickets, your account will be disabled until you answer our questions.
IntellyHost.com shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from IntellyHost.com servers going off-line or being unavailable for any reason whatsoever. Furthermore, IntellyHost.com shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of IntellyHost.com servers. All damages shall be limited to the immediate termination of service.
We carefully evaluate new accounts to determine high risk orders. Please do not take it personally if you are asked to verify a new account as you may have been selected randomly. Please provide the requested information at your earliest convenience to ensure that your account is set up as soon as possible.
IntellyHost.com cannot be held liable for system downtime, crashes, or data loss. We cannot be held liable for any predicted estimate of profits in which a client would have gained if their site was functioning. Certain services provided by IntellyHost.com are resold. Thus, certain equipment, routing, software, and programming used by IntellyHost.com are not directly owned or written by IntellyHost.com. Moreover, IntellyHost.com holds no responsibility for the use of our clients accounts. If any terms or conditions are failed to be followed, the account in question will be automatically deactivated. We reserve the right to remove any account without advanced notice for any reason without restitution as IntellyHost.com sees fit. FURTHERMORE, IntellyHost.com retains the right to change any or all of the above Policies, Guidelines, and Disclaimer without notification.
IntellyHost.com strives to maintain a 99.9% network and server uptime service level. This uptime percentage is a monthly figure, and is calculated solely by IntellyHost.com monitoring systems or IntellyHost.com authorized/contracted outside monitoring services. If IntellyHost.com fails to meet its 99.9% uptime guarantee, and it is not due to one of the exceptions below, credits will be made available to each client, upon request, on a case by case basis. IntellyHost.com does not credit a full month's service for minor downtime. This would not be financially healthy for IntellyHost.com, and in turn would only negatively affect the service level IntellyHost.com provides to you. "Partial refunds for partial downtime" is our standard policy. In extreme circumstances, IntellyHost.com may distribute full month credits, but this is dealt with on a case by case basis. Credits are issued for one monthâ€™s service only, never more.
